WINSTED — Longtime Town Attorney Kevin F. Nelligan is the low bidder, and now it’s up to selectmen to decide if they will continue to employ him.
Bids for a town counsel re­quested by selectmen Nov. 19 were opened on Thursday, and Nelligan offered to continue in his position for $100 an hour, a rate which covers all services.
A local law firm, Dixon & Brooks, offered to perform gen­eral work for $125 an hour, with a rate of $175 an hour charged for litigation. The Hartford firm Halloran and Sage bid $175 an hour for a full partner, $135 an hour if an associate performs the work.
Mayor Kenneth J. Fracasso said on Thursday he expects the town will stick with Nelligan, who has held the position since 1990.
A vote could be taken when selectmen meet Monday.
“I think Kevin’s done a fine job,” Fracasso said. “I would
think that’s the way we would go.”
Fellow Republican Select­man David A. Cappabianca said he was not prepared to opine without having seen the actual bids.
“I really don’t know,” Cap­pabianca said. “I want to dis­cuss it with the other selectmen. I’d have to give it some thought.”
Attorney Judith Dixon, one of two partners in Dixon and Brooks, is currently employed as the town attorney for Sharon, Canaan and North Canaan, ac­cording to her firm’s web site. Dixon is also a longtime mem­ber of the local Republican Town Committee.
Nelligan noted in a Dec. 3 let­ter to selectmen the town has yet to lose a court challenge during his tenure. His $100 an hour bid covers all services. The Dixon and Brooks bid stip­ulates paralegal services will be billed at $110 per hour. Hallo­ran and Sage proposed charg­ing $90 an hour for paralegal services.

DO the right thing for the communtiy-Keep Nelligan at $100.00 per hour

Do the right thing for the RTC- Hire Dixon- at well... it depends on the situation, but it will probably  be more than $100.00 an hour.

this is nice that the area newspapers (some) are speaking out now....woulda been a whole lot more beneficial to the citizens of winsted if they'da done it during the campaign back in november - instead they backed the thugs - and it might be too late to stop this train - hey charter experts?  anything in the charter call for impeachment of the whole bos?

Replacing Town Attorney Would Be Unwise Move

A push by the new Republican-led Board of Selectmen to fire Town Attorney Kevin Nelligan and replace him with a more costly attorney has certainly raised eyebrows and probably created some anger among residents who feel the board is starting to act like a group of thugs.

Fortunately for Nelligan, the motion to replace him with Republican Judy Dixon, a member of the Republican Town Committee, was tabled Monday night, as minority Democrats Candy Perez and Michael Renzullo questioned the motivation of David Cappabianca, who brought the motion forward.

Cappabianca said he "thinks" Dixon will be less expensive than Nelligan in the long run because there would be "potentially" less litigation. That statement opened up a firestorm of criticism from Perez, who said you can't base such decisions on what you "think." Perez said the board needed real data in order to determine if hiring a new attorney would be a fiscally responsible move.

Perez and Renzullo also noted that Dixon intends to charge the town $175 per hour, compared with Nelligan’s $100 per hour. Dixon’s paralegal even charges more than Nelligan, at a rate of $110 per hour.

At least one Republican on the board, Mayor Kenneth Fracasso, was swayed by the Democrats arguments and said he supports keeping Nelligan on board as town attorney. Fellow Republican Jeffrey Liskin may be the swing vote, but he made the motion to table the issue until the board’s next meeting.

If the board does vote to ditch Nelligan in favor of Dixon, it will be seen as a waste of money for political purposes. It will also be seen as a slap in the face to Nelligan, a popular, friendly attorney from Winsted who has earned the respect of townspeople for the past 18 years and has never lost a case for the town.

Winsted First ... Eh What ?

Maybe I'm way off base here and the older I get the more memory lost but wasn't the Republicans slogan 'Winsted First' ? I thought so .

Did they forget to tell cappy about the slogan or was it just the first of many hollow promises to come from them?

What part of 'Winsted First 'has anything to do with hiring the most expensive lawyer ?

cappys showing his true colors on this one and whether he gets her in as OUR lawyer or not it needs to be remembered by the Town that this fellow doesn't have the Towns interests at heart .

What part of ' Winsted First' has to do with pissing away $20K or more of OUR money (without a proper transfer of funds ((read legal transfer)) to fire and hire town managers in such a haphazard manner and clearly with no plan for continuity in that office until they their phony bologna charter commitee does it's work?

The long and short is that they took Silano's money and they have to follow his directives .

His directive is that anyone he percieves as a impediment to his development plans has to be eliminated from power .

cappy has said publicaly that Nelligan is percieved as an impediment to that goal. 12/19/07 Wtby./Rep. 'Cappabianca said Nelligan has given questionable advice to town land use boards re­garding Aurora Estates and other development projects.'

Dixon will apparently translate law to us in a manner more friendlyand less 'questionable' to the likes of Silano and his group of people. People with warm  friendly names like crozier and grimes .

Law is funny that way I guess. You buy the 'questionable'interpretation you want
